“In my 26 years of practice, I have never dealt with a situation quite like this.  We came to a confidential agreement and yet within hours, rumors about what happened in the mediation were flying around the web and being accepted by news organizations as absolute fact. Carrie and I plan to continue to honor our confidentiality agreement with the other parties. But I can tell you this; many of the rumors circulating are inaccurate and misleading.”

EXCLUSIVE: Carrie Prejean Takes Legal Action Against Miss California USA Officials

RANCHO SANTA FE, CA – Carrie Prejean’s attorney, Charles S. LiMandri announced today that the former Miss California USA is filing a complaint in the Superior Court of California against Miss California USA officials Keith Lewis and Shanna Moakler, and publicist Roger Neal.  The complaint cites damages to Miss Prejean including libel, public disclosure of private facts, religious discrimination, intentional infliction of emotional distress, and negligent infliction of emotional distress.  

Miss Prejean was fired from her role as Miss California USA in June of this year, following several months of controversy over her answer at the Miss USA pageant regarding same-sex marriage. Lewis claimed Miss Prejean’s termination was due to a violation of contract.  Miss Prejean’s complaint will refute that allegation, and demonstrate that both the chronology and factual evidence clearly show she lived up to all her contractual obligations, but was fired, harassed and publicly attacked solely due to her religious beliefs.

Yes, in an image by Drew Friedman published online by Vanity Fair on July 29, 2008. That drawing at least played into a view of Bush popular among his detractors, that the former president was unpredictable and fast on the draw when it came to geopolitics. But the danger many of Obama’s detractors detect is more of calculating, long-standing deception, that he is quietly and secretly marshaling a socialist agenda, a view that would be better served by imagery that recalled “The Manchurian Candidate.”

The folks at Entertainment Weekly see little wrong with the tabloid exploits of blogger Perez Hilton. The fevered mind behind Perezhilton.com, a site that makes US Weekly look like The Economist, gets a glowing feature article in this week’s edition. The mag allowed Hilton, known for scribbling angry/hateful/pornographic images all over celebrity pics, to decorate his own portrait with terms like “Zexy,” “Faboosh” and “Hawt.”

But that’s nothing compared to the kid glove treatment Hilton gets in the accompanying text.

For the uninitiated, Hilton runs one of the most popular tabloid sites on the Web, and his most recent claim to fame was grossly insulting Miss California, Carrie Prejean, after she dared to oppose gay marriage during the recent Miss USA pageant. (more…)

Mario Lavandeira, the mean-spirited impresario behind the celebrity-obsessed mega-Web site PerezHilton.com, was left scratching his pink-tinged pompadour last week, wondering aloud in a campy cry-baby YouTube classic why, after being physically assaulted in public, he is now universally scorned and widely considered the villain of an incident that left him appropriately “black eyed.”

Aside from the basic rules of karma, here’s why: The calculus of political correctness is like roshambo, the “rock-paper-scissors” game. Different identity groups hold specific levels of power over others when their battles play out in the media. To wit: Black beats white. Gay beats white. Black beats gay.

Don’t ask why. It just is.

For those not paying attention to this tawdry tale, Mr. Lavandeira, aka Perez Hilton and the self-proclaimed “Queen of All Media,” referred to Will.I.Am, the black frontman of the platinum-selling Black Eyed Peas, by an anti-gay slur at an after-party of the MuchMusic Awards in Canada.

This interlude was born of the L.A.-based hip hop trio’s displeasure over critical comments about their recent album on the Perez Hilton Web site. The affair later culminated in the band’s black manager, Polo Molina, reportedly slugging Mr. Lavandeira after an evening of silly ego- skirmishes between the two parties. (more…)

RE: Carrie Prejean v. Keith Lewis, Shana Moakler, and K2 Productions, Inc.

Dear Mr. Shields:

We are writing in response to your letter of June 13, 2009.  There have been multiple written communications from me to you since the date of that letter addressing these various issues in detail, and which we will not repeat at this time.  Since your letter was released to the press, however, with the attachments, we feel it necessary to address some of the more egregious misrepresentations made in that letter.

1.         There Was No Unauthorized Participation in Literary Works.

As you well know, both Keith Lewis and Donald Trump had given preliminary approval to Ms. Prejean to write a book.  In fact, Mr. Trump’s office had circulated a draft amendment to her contract for that purpose at the time that she was terminated – - without warning and without just cause.  She did not yet have a contract with a book publisher at the time she was terminated.  She did have a contract with a literary publicist to find a publisher for the book, which was the source of the confusion about this issue.  Without giving Ms. Prejean or me an opportunity to clarify the matter, she was abruptly terminated.  The fact that she was working on a book was well known and was discussed multiple times, both verbally and in writing. Obviously, the book had not yet been published, and there can be no material breach of contract at issue here.  Therefore, the reason given for her termination as being based in part upon her doing a book deal is a complete and utter pretext.  (more…)

I Come to Praise Bill Maher, Not to Bury Him

As recently as a few hours ago, my buddy Jimmy Arone joined many on this site in giving Bill Maher a well-deserved thrashing. But I’m feeling a responsibility to give credit where credit is due.  Maher may be a leftist ideologue, but when he’s not getting what he wants, at least he lashes out equally. No sacred cow is President Obama:


My favorite part of that video is the quick shot of Chris Matthews. Even as he plays trained seal, his eyes betray a man dying slowly inside as Maher savages the thrill up his leg.  

Now, we can nitpick and say that at times Maher’s been harder on Bush, but there’s no ignoring the fact that Obama’s taking some withering fire there. This probably won’t satisfy those upset at the glaring double standard we’re seeing from television “comedians,” but I find it unrealistic to want Maher or any leftist comedian go after Obama in the same way they went after Bush. They like Obama, they hate Bush. What do you expect? Had someone lost their mind and handed me a Late Night show, I’d be just as biased. For instance, there’s no way I’d ridicule Sarah Palin or Carrie Prejean.  I admire them too much. Nancy Pelosi, however… (more…)

Big Hollywood Exclusive: Prejean Attorney Provides Playboy Emails; Carrie ‘is being persecuted for same-sex marriage’ beliefs

Miss California USA Pageant Director Keith Lewis explained the decision to fire then-Miss California Carrie Prejean in the following statement: “This was a decision based solely on contract violations including Ms. Prejean’s unwillingness to make appearances on behalf of the Miss California USA organization.”

But In an exclusive interview with Big Hollywood, Ms. Prejean’s attorney, Charles S. LiMandri, who says that he and his client learned of the firing during a phone call from gossip site TMZ, vehemently denies those allegations.

“She greeted troops, ‘Fox and Friends,’ she was lined up for the Special Olympics this weekend. It is pure BS.”  He continued that neither the Miss California USA Pageant organization nor Miss USA owner Donald Trump had ever taken issue with the frequency of her media appearances: “They never said it was a problem.”

According to Mr. LiMandri, the real reason behind the firing was three-fold: His client’s beliefs regarding same-sex marriage, a possible book deal with his client (a deal approved by Mr. Trump), and the fact that Ms. Prejean refused to pose for Playboy Magazine or participate in a docudrama promoting same-sex marriage.  (more…)

Let me begin by saying I treasure the opportunity I’ve had to represent the great State of California, and I would like to extend my deepest gratitude to the thousands of Californians, and other Americans, I have met and who have stood with me through this controversial firestorm. One of the many enduring things about being Miss California USA was the opportunity to get to meet and know so many wonderful people. I would not be the strong, courageous woman I am today without your support, and prayers.

I would like to thank Mr. Donald Trump and his organization for his support and defending me through the most challenging time of my life. I am so grateful for him, and the opportunity I’ve had to get to know him. I admire, and respect him. I wish Tami Farrell the best; I know she will do a great job.

I hope Americans watching this story unfold, take away the most important lesson I have learned through all of this: nothing is more important than standing up for what you believe in, no matter what the cost may be. I am in shock that K2 Productions and the Miss California USA Pageant have taken the steps to fire Carrie Prejean today. The claim that she has an unauthorized book contract is false. She does not. The claim that she is refusing to appear is false. Carrie has been in constant contact with pageant officials seeking to fulfill her obligations. I have emails in my possession tied to the pageant organization as recently as last Friday citing future appearance requests for Carrie. She represented the Pageant in Las Vegas the weekend before last, and is scheduled to appear at a Special Olympics event this weekend in California, a cause dear to her heart. Political Late Night Winners and Losers

It had been about three weeks since my last Late Night review, so I thought the time was right. Wednesday Night, May 20, 2009, I reviewed: David LettermanJay Leno, Jimmy KimmelCraig Ferguson, Jon Stewart, Stephen Colbert, and Jimmy Fallon. I also took a look at the “Real Time with Bill Maher” from Friday May 19, and The season finale of Saturday Night Live.

Since my last review, we saw: A stand up comedy routine that was apparently gleaned from the mistaken assumption, that jokes about President Bush were standard Correspondent’s Dinner protocol. President Obama also announced his plan to save the auto companies by forcing them to raise their prices thirteen-hundred dollars (proving He has less business sense than the cartoon Wal-Mart slasher). He appeared on stage with a handful of people beholden to bailout money in a photo-op that looked very much like a hostage situation. Photographed on stage with Governors’ Granholm and Schwarzenegger, you had to guess which leader actually had a US birth certificate. He also broke his promises to end military tribunals, release the interrogation photos and suspend don’t ask don’t tell. He proved that He had as much problem speaking “Mexican,” as he has with “Austrian,” and promised to drastically slash the overdrawn budget by a whopping 1/2 of 1 %. (more…)

Of course, to be un-PC doesn’t mean going out and insulting everyone. Bad behavior isn’t going to win you friends. But a lot of the alleged outrage out there from the PC clowns is bogus and it should not be allowed to pass anymore.

No one can legitimately claim that the Judge-the-beauty-talking-guy came out on top of the California-pretty-girl-have-title in the recent Ms.-Fifty-States-show.  Sorry, I just can’t bring myself to write the words Perez, Miss California and Miss USA again.

In the past, the traditional media’s word would have been the end of the story.  Ms. Prejean would have been cast as ignorant and most likely lost her “crown” ten years ago.  Not sure what the equivalent in 1999 would be to “I believe in opposite marriage,” but the negative mainstream spin on the story would have stuck.  Not this time.  I wrote a piece about gay marriage and the danger of silencing the pro Prop. 8 constituency a while back. A few weeks ago I was at the Fox Studios in New York City preparing to make an appearance on the Cavuto show. Mr. Cavuto invited me to talk about my recently published business book, “I’ll Make You An Offer You Can’t Refuse,” and the “Machiavellian” approach to business some people in the Obama administration appear to be taking. I was chatting with one of the show’s producers, explaining how the mob would lend money to a business and then take control of the company (sound familiar?), when a beautiful, blond woman came bursting through the door of the green room with her entourage in tow.

Turns out she was Miss California, Carrie Prejean, the reigning queen of the state in which I just happen to reside. Cavuto’s producers were able to nab the beauty for an early interview. My wife and I and two of our daughters watched from the green room as Miss Prejean very respectfully stated her belief that marriage should be between a man and a woman. Before seeing her interview, I was unaware that her response to a question posed to her on the subject during Sunday’s Miss USA competition had quite possibly cost her the Miss USA crown. (more…)

The same-sex marriage controversy that hijacked the recent Miss USA pageant-and our televisions and radios every day since-has now claimed another victim: Miss California co-director Shanna Moakler.  With Donald Trump having decided to let Carrie Prejean keep her crown, there is apparently not room enough for both beauty queens, and Moakler has chosen to resign out of principle, “to be a role model for [her] children.” 

What, exactly, is the principle that Moakler must resign to protect?  It likely has nothing to do with the scandal over Prejean’s topless photos, since Moakler has shown far more of herself in Playboy.  No, Moakler’s concern is Prejean’s insistence on pressing a political agenda: “In the entire history of Miss USA, no reigning titleholder has so readily committed her face and voice to a more divisive or polarizing issue.”

Funny – I don’t recall Prejean injecting the issue of same-sex marriage into Miss USA; the blame for that falls in the lap of celebrity judge and gay activist Perez Hilton, a man best known for decorating celebrity photographs with bodily fluids and infantile commentary.  Prejean did not cause this conflagration.  It must be clear to everybody-even Moakler-that she would have preferred to avoid the question entirely.  

It is not Prejean’s fault that she became a spokesperson on same-sex marriage.  But Moakler isn’t upset that Prejean is speaking out on the topic.  Not really.  Moakler herself has taken a very vocal position in favor of same-sex marriage.  Recently, she even posed for an advertisement with two other beauty queens, all three with mouths taped shut, presumably to make the point that somebody-it isn’t entirely clear who-is muzzling them on the subject of same-sex marriage.   (more…)

So two women are in the news today: Janeane Garofalo for refusing to apologize after calling every single tea party protestor racist – and Carrie Prejean, still, for answering a question honestly about her religious convictions.

Now Jeanane was approached by Fox New`s own Griff Jenkens, who had asked her if she regretted her blanket stereotyping. To her strange, delusional credit, she stood by her original comments: that every tea party protestor hates black people.

Meanwhile, Prejean continues to be hounded over semi nude pictures. I would call the photos topless, but technically that`s untrue, what with that target on her back (a target that was placed for holding the same beliefs as our Commander in chief).

Now, according to Griff, Janeane is so enraged at the world and the conservatives who happen to live in it – she confessed to cutting out chunks of her hair. Which is weird, because other than Fox News, no one in the media seems to be questioning her comments. (more…)

Is Miss California the New Leo Penn?

Leo Penn, the father of famous actor Sean Penn, was hauled before the House Committee on Un-American Activities (the McCarthy hearings) during the 1950s and harassed, spied upon and ultimately blacklisted for his political views (he attended a pro-union meeting called to support other black- listees.)

He refused to accuse others, and lost his livelihood for a period of time, but went on to direct many TV shows including Star Trek, The Law and Mr. Jones, and I Spy.

Now Carrie Prejean, beauty queen and determined supporter of marriage between a man and a woman, finds herself smeared on the Internet, castigated in public, on TV, (Chelsea Handler on E! channel has taken aim with a vicious gleam in her vodka-stoked eyes) and her parents have been dragged through the mud as well.

So where are the free-speech warriors? How about Sean Penn and the rest of the Hollywood elitists who think the First Amendment was written solely for their benefit? Penn has made millions playing everything from a stoner in “Fast Times at Ridgemont High,” to gay Supervisor Harvey Milk, who was slain in a horrific attack in San Francisco that also resulted in the death of San Francisco mayor George Moscone. So Mel Gibson’s getting flack for having sex with a woman who was not his wife – something that never happens in Hollywood – but made newsworthy because he’s a hardcore Catholic. Meanwhile, Carrie Prejean continues to be crucified – for she’s a Christian who posed topless to get a job. And of course, there’s Bristol Palin, unwed and baby in tow, talking abstinence.

Of course, when it comes to this stuff, the media shifts into the only gear they know – the typed-in equivalent of Nelson Munz`s laugh.

Yeah, we get it: these Christians are all hypocrites, and you’re not. (more…)

People Magazine’s Pathetic Predictability

In the 1984 NBA draft, the Portland Trail Blazers used the second pick to select University of Kentucky star Sam Bowie over then 21-year-old Michael Jordan, marking the greatest oversight in our nation’s history.  Until now.  On newsstands today you’ll find People Magazine’s “100 Most Beautiful” edition.  Anyone modestly attentive to American culture will notice the conspicuous absence of the flyest honey ever to rep the GOP on the national stage: Sarah Palin.

This error would be egregious even without context, but wait until you hear who actually made the list:

There is an entire spread called “Barack’s Beauties” featuring seven Obama staffers who are among the USA’s finest 100–easily the highest number of executive branch hotties since the Coolidge administration. (more…)
