I think that Justice Kennedy's wise and appropriate decision to reject Howard's petition may prove to be one of the last blows necessary to finally defeat the frivolous claim against the Marshall Estate. After over a decade of Anna forum-shopping her claim around to any number of courts and never receiving a legitimate favorable decision, it seems that the Marshall family is very close to having this business behind them and to justice being served. I am sure the 9th circuit, where the case was remanded to, will deal a similar blow to the claim in court if Anna's estate decides to further her claim. I just hope that whomever is calling the shots with regards to that claim has a brain in their head and sees that they aren't merely trying to swim upstream but they're trying to swim up a waterfall and that their case is destined to receive an unfavorable judgment.

Bravo! It's about time someone started talking about justice--albeit delayed--for the Marshall family!

It strikes me how her relationship with Stern in the end was much like her relationship with Marshall. Think about it.

Yes, Anna Nicole Smith was responsible for her life and the results of her actions. Still, is not a person who takes advantage of a person in a vulnerable state also responsible for their actions?

As I recall, Stern assumed control over every tiny detail of Miss Smith's life towards the end. One only has to watch that video -- shot by Stern -- of a pregnant Anna Nicole Smith, apparently stoned and in clown makeup. Stern speculates on the video how much it will be worth.

Yes, everyone must answer for their actions. It seems as though Stern may be providing a few answers soon to a court.

How anyone close to Anna Nicole Smith can ever claim they looked out for her best interest is a liar...

Maybe, but she was an adult folks. She made her bed, and she lied in it. She then suffered the consequences. And unfortunately, some of those around her suffered as well. On the other hand, maybe her daughter is better off (mean, I know, but probably true nonetheless).

And unless someone here has some proof that the doctors and Stern held her down, and shoved those drugs down her throat, this is all conjecture. We should all be capable of making our own decisions.

It's odd that a conservative site like this one is so quick to blame everyone for Smith's death except who really is to blame. I thought we left the finger-pointing to the liberals.

There's a reason why lawyers who maintain their sanity say "we practice law, justice is for a higher authority." Justice is a tough term to deal with, even in theology. In the law, it's deadly. I've been watching this spectacle since it began, and I haven't found anyone to root for yet. Although I must admit I feel a certain schadenfreude watching the lawyer/participant in this magnum opus squirm. And if you think you're going to see solid law or even justice come out of the Ninth Circuit, I have some really bad news for you.

And on a serious note...A homicide detective acquantice of mine commented after Anna Nicole Smith's son died from an OD, "If his mom OD's in a few weeks, that's a case that I'll want to work." Howard K. Stern sure made this whole thing seem like a Columbo episode.

A fine story that reminds of the irony that cockroaches and lawsuits will survive us all.
