The ‘Magic Latina’

The Sonia Sotomayor candidacy for Supreme Court Justice is beginning to heat up. There is much to admire about her personal story and success. But she should not be confirmed as a Justice. Most commentaries discuss the optimal way for Republicans to lose the debate. Of course she will be confirmed, all agree. Democrats happily dare Republicans to attack her Hispanic–or is it Latina?–heritage. (As an aside, my wife, who is a Cuban born emigre, has been confounded many times as to which “box to check” on various forms we all confront from time to time.)
Republicans shiver in their boots as they debate the question of whether to attack Sonia Sotomayor for her “wise Latina women are wiser than white males” quote, or for her “the Appeals Court makes public policy” quote. All Republicans are warned vociferously–and they agree just as vociferously–to not make “personal attacks.” The fact that no one has made, or suggested Republicans make, personal attacks is seemingly ignored.
The predominant Republican strategy had been to focus on a “judicial merits based” approach and stay away from the “ethnicity issue.” But polling data must have been stronger than expected as some Republicans begin criticizing her racially oriented comments. Newt Gingrich has been the most aggressive prominent Republican in his critique, saying Sotomayor should not be confirmed. But even as people like Mitt Romney and Lindsay Graham are becoming more vocal, they are distancing themselves from Gingrich’s comments. As a result, he seems “extreme.” The Peggy Noonan wing of the Republican Party continues to be its own worst enemy. This group is clueless. It does not realize her “wise Latina women make better decisions” and her “Appeals Court makes public policy” comments are neo-Marxist deconstructionist ideas, not “off the cuff” remarks.
It is precisely her status as a racial “Latina” and her status as an “oppressed” minority that permits a double standard. Why does this double standard carry so much weight in our society? Republicans often go through the motions of expressing outrage, but their heart does not seem in it. If one is not going to oppose her nomination, then why bring it up at all? Beginning in the late1960s, our education establishment began the process of discrediting America’s “dead white male” American history, culture and politics. American values have been continuously “deconstructed.” (For a serious yet humorous discussion on “deconstruction in education,” I recommend Charlotte Allen’s “Why Can’t a Girl Have a Penis?”). This deconstruction attack by our education elites has had great success. Even the so called conservative intelligentsia has all but conceded the point, de facto, that the double standard is appropriate.
I also think there is a second reason for the strength of this double standard. Sotomayor’s “wise Latina woman” comment has weirdly tapped into a cultural archetype that appears frequently in literature and cinema. She ironically seems to be a believer in a self serving stereotype that has been criticized by both conservatives and liberals. Spike Lee and Richard Brookhiser, in two unrelated commentaries in 2001, called this archetype respectively, “the Magic Negro” and “the Numinous Negro.” Lee discussed the Magic Negro during a speech at Yale University in March 2001, and Brookhiser wrote of the Numinous Negro in National Review in August of the same year. American science fiction writer of Nigerian descent, Nnedi Okorafor, has also written about the concept of the Magic Negro. She has said;
“The Magic Negro, [although] typically black, can be [any] person of color. [They appear] in a story about predominantly white characters {and are} wise, patient, and spiritually in touch. Closer to the earth, one might say. He or she often literally has magical powers [and] seems to have nothing better to do than help the white protagonist, who is often a stranger to the Magical Negro at first.”
The implied racial politics of the Magic Negro construct is interesting and not obvious. Brookhiser, a conservative, and Lee, a liberal, not surprisingly, come at the politics of these characterizations differently, even as their views are more similar than different. Brookhiser’s Numinous Negro is a broader category which contains, as a subset, Lee’s Magic Negro. Lee has focused specifically on the appearance of Magic Negroes in the cinema. In his Yale speech, Lee critiqued several movies, including “The Green Mile” and “The Legend of Bagger Vance.” Lee’s main thesis, supported (later in 2004) by the more coherent and intellectual Okorafor, is such movies produce racial stereotypes which unconsciously represent “less savory beliefs about race in the American public’s psyche.” Lee said about “The Legend of Bagger Vance,” which is set in Georgia during the depression, that
“Blacks are getting lynched left and right, and Bagger Vance is more concerned about improving Matt Damon’s golf swing. I get mad just thinking about it. They are still doing the same old thing…recycling the noble savage and the happy slave.”
The fact that Lee has completely misunderstood “Bagger Vance” is beside the point. (“Bagger Vance” author, Steven Pressfield, wrote a forward to Hinduism scholar Steven Rosen’s book on Bagger Vance, “Gita on the Green,” which discusses the parallels between the Will Smith character and the Hindu god Lord Krishna.) We all recognize the cinematic and literary characters Lee and Okorafor discuss. The website, A.V. Club, lists 13 movies featuring “magical black men.” Examples of Hispanic or Latin “magical” characters in literature include the supposedly real Don Juan Matus, the Yaqui Shaman immortalized by Carlos Casteneda in his Trilogy written in the late 1960s; and the clairvoyant Clara in Isabel Allende’s, House of the Spirits.
Okorafor explains the attractiveness of the idea of the Magic Negro for whites when she quotes producer Damon Lee; “I truly believe that white people are more comfortable listening to black people when they are cast in a magical role.” In 2007, David Ehrenstein of the LA Times, reprised Damon Lee’s argument when he said;
“Like a comic-book superhero, Obama is there to help, out of the sheer goodness of a heart we need not know or understand. For as with all Magic Negroes, the less real he seems, the more desirable he becomes. If he were real, white America couldn’t project all its fantasies of curative black benevolence on him.”
Ehrenstein’s argument is that America is still racist; does not want to be; but the only way we could avoid it was to project “Magic Negro” status onto Obama.
Brookhiser perceives the same phenomenon in cinema and literature as Lee and Okorafor, but his “Numinous Negro” also includes actual people. He believes that our modern culture has quasi-deified certain individuals who are black. Also, where Spike Lee, Damon Lee and Nnedi Okorafor see these as unconsciously negative black racial stereotypes, Brookhiser sees these characterizations as racial stereotypes against whites. Who is the Numinous Negro? Says Brookhiser in 2001;
“The Numinous Negro is a presiding divinity. The place he presides over is America, and contact with him elevates us spiritually. You see him in the gooey prose of white liberals whenever a Negro appears (“Negro” was the accepted word when blacks first became Numinous). Dozens of examples could be culled from the work of the late Murray Kempton, though his humor operated as a brake on his piety. The work of Garry Wills, who has no humor at all, would yield thousands of examples. The Numinous Negro need not be a man. Toni Morrison and Oprah are Numinous Negroes (Ms. Morrison is a seer; Oprah is a sage).”
Brookhiser agrees that “The Green Mile” and “The Shawshank Redemption,” for example, have “Numinous Negros” as their main characters. Conservatives are rebuked as well. He rhetorically and sarcastically asks; “Who is the black man at a Heritage/AEI/Manhattan Institute pow-wow? Answer? The Speaker.” Interestingly, Brookhiser was heralding the “end” of the Numinous Negro back in 2001. He clearly wishes race consciousness would disappear. As he says:
“There have long been more German Americans than Black Americans, but the former have made no impression on the national mind greater than the Katzenjammer Kids…..Maybe when the Numinous Negro has gone away, more Black and White Americans will meet each other. We should not hold our breaths, nor despair.”
Sotomayor’s now famous comment; “a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life” fits the narrative of the “Magic Negro” perfectly. She seems to believe she is a “Magic Negro,” as she proudly asserts her ethnicity as a cause of her wisdom. Barack Obama emphasizes the importance of “empathy,” clearly implying her background gives special insight into the law. The left, as always, want it both ways. Frankly, the Lee/Brookhiser/Okorafor arguments are pretty persuasive. Movies and novels featuring “Magic Negroes” have become almost cringe inducing. But don’t expect Spike Lee to criticize Sotomayor any time soon.
A strong anti-American strain is becoming increasingly calcified into the American body politic. The Sotomayor candidacy is a great opportunity to bring this strain to the forefront and force a debate through her nomination process. Two fundamentally anti-American ideas have surfaced as a result of her nomination:
1) Identity politics are more important than both “the law” and the traditional American “melting pot.”
2) The judiciary’s primary role is to subjectively do what is “right” rather than make a good faith effort to follow the law.
Sitting back and being afraid to be called racist is not what is needed from the Republicans. They should disband rather than follow that route. Sotomayor should be compelled to explain her past statements for the public to hear.
We don’t need Magic Negroes, Magic Latinas, or Magic Caucasians in politics or our judiciary.

Racial and identity politics brought to you wholesale. Everything from enabling enterprises like ACORN and SEIU to engage in voter fraud and intimidation. Massive redistribution of OUR money to the (some would say criminal) underclass. The insistence of emotion as a legal argument. The lionization into cult status of the 44th President.
The immediate response of the newly empowered hissing vipers of the left. And now the debate as to whether those who question irrational and race based comments by a mediocrity such as Judge Sotomayor are themselves somehow 'racist'?

No, it was substantive. Their comments were based entirely on a racialist statement she had made, which was entirely in line with her actions in the Ricci case as well as other comments and writings. Even the Obama administration realizes the problem she has, as they try to say she "misspoke" or poorly chose her words. The entire context of her speech was race based, and the rebuttal offered the following day clearly addressed her comments as essentially racist in nature.

Thanks for articulating what I have felt for some time was wrong with the idea of Sotomayor as a SC Justice. Ms Sotomayor's career indicates that she views the law as a tool for social change, although admittedly, her rulings have been benign. I want a Supreme Court that will "do what is 'right'"; I define 'right' as upholding and sustaining the law (admittedly, it pains me when stupid/immoral laws are upheld, but an activist SC is not the way to change them). Activist rulings (even the ones I would agree with) at this level invite a national malaise that lasts for generations.
Republicans should say that they are opposing Sotomayor for the same reason Obama opposed Roberts and Alito.

Wow. You sure told us, didn't you? Most intelligent people have given up the concept that in our daily lives that it is realistically possible not to notice race or ethnicity. It is not that important to be color-blind, but it is very important that color doesn't matter. Sotomayor is a candidate for the Supreme Court. She should be both color-blind and unmoved by the race, creed, color, national origin or economic status of persons before her court. Sotomayor brought the issue of race and ethnicity up. We would be fools to pretend we didn't hear it and judge her as if she could still be an impartial judge. It's a little hard to ignore her ethnicity in any discussion of her qualifications since she herself made it the major issue.
She's the one who made race a factor with her remarks, Genius!

Hence, Sotomayor is a racist because she has the belief that being Latina makes her wiser than a White man. This is a bad as a Klansman saying his White skin makes him smart than a Black man.
So, Newt and Rush are correct in their labeling of Sotomayor. Sure, too many buy into the "Only White people are racist" myth. (My wife and I recently had a debate with my mother about this.) But that doesn't make Sotomayor's racism any less true.
I think it is a mistake to play this ridiculous game of gotcha. The "policy" comment was nothing more than telling the truth in a light hearted setting. Everyone knows that policy issues, both conservative and liberal, are fashioned in the federal courts. To deny that fact tortures logic. We've become so sensitive and hypocritical to anyone uttering a politically-incorrect truth, that it's a wonder we can communicate at all. As for the "Latina" comment, does this really rattle any cages? Do you think she really and truly believed that to be true or simply intended to make a point about the stuffiness that permeates our legal system? Is there anything about her actual work on the bench to indicate she is, in fact, a racist or mutilating the law to achieve some leftist political end?
Shouldn't her work in the law be the focus of our concern?
When Mr. Rulle referenced Charlotte Allen’s “Why Can’t a Girl Have a Penis?”, my first thought was "a girl can have a penis almost any time she wants one, all she has to do is ask." Does that make me immature?
With respect to whether calling someone a "racist" is a personal attack, it seems to me that leftists such as CgntvDssdnt feel free to label anyone who disagrees with their position as "racist" without concern as to whether it is a personal attack. However, it seems that the better approach would be to label Judge Sotomayor's comments as racist, not label her as a "racist." It is wrong when leftists unfairly label conservatives as racists, so it should be wrong for conservatives to unfairly label leftists such as Judge Sotomayor as a racist on the basis of a single comment. She may be a racist, but it would take more than a single comment to establish the fact.
Sotomayor was picked at least in part because of her race – not because Obama is necessarily race-fixated, but because he's a fairly brilliant political strategist. Like it or not.
Position wise she doesn't change the makeup of the court one iota by replacing Souter. The game here is getting Republicans to talk about race and further-alienate the growing Hispanic voting bloc who right now can largely go either way – they "like" the Democrats on fiscal/government policy, but they "like" the Republicans on social issues (unsurprising given that so many trace direct and recent routes to third-world nations dominated by archaic religiousity.) It's a trap, basically, so have fun with that

Stephen King often employs the 'magical negro' in his books. He's the author of the source stories for both "Shawshank Redemption" and "The Green Mile" referenced above. In "The Shining," the repairman Dick Hallorann (portrayed so well by Scatman Cruthers in the film) is another truly magical negro who shares the 'shine' with the boy, Danny. In the novel he saves the day. Unfortunately in the film he was dispatched after being reduced to a useful distraction in one of the most thankless deaths ever placed on film. Now, with Sotomayor, the 'authentic,' 'earthy' and 'wise' non-caucasian will be able to again show America the error of its terrible past. Qualifications are irrelevant, heritage everything, ethnicity over-riding and non-white the holy grail in modern America. We'll see who asks which questions at her hearing.

Umm the title of her speech is "A Latina Judge's Voice." Yup sounds like her quote is taken out of context to me.

Beautiful article. Lots to think about. Today, to further muddy the waters, Sotomayor claims she will "follow the law." So who is she really? What does she truly believe, really? If her most recent comments are true, which I doubt based on her previous comments, then her race, color, ancestry are irrelevant. The United States is morphing, culturally and politically. The Right, other than Mr Rulle doesn't seem to be aware of it and certainly don't know what to do about it. We talk, they act. Tis ashame really because IMO what the 'progressive' side of the family would give us will certainly take us the ideological route of Caligula's Rome. Insanity and mayhem.

To Dems and SCOTUS nominees, there's one thing that matters, and it's not the feel goody-goody of a Hispanic madre. If she's reliably pro-abortion, she could be caught on tape clubbing seals and shopping at Wal-Mart, an she'll ease through. If she's not reliable, she can expect her garbage to be sorted through.

Whenever I hear that Sonia Sotomayor has a compelling life story, the opening to Steve Martins 'The Jerk' keeps running through my head…'My story? Okay. It was never easy for me. I was born a poor black child. I remember the days, sittin' on the porch with my family, singin' and dancin' down in Mississippi". Enough with the compelling life stories! We all have life stories, some compelling, some not so much.

Sotomayer deserves to be treated no differently than the rules set by Ted Kennedy and the conformation of Judge Robert Bork, a legal genius by the way. Sotomayer needs to be asked directly and often about her comments we know of, that are racist, and usurps the will of the people by legislation from the bench. “What do you mean by this Judge Sotomayer?” She’s going to get on the SCOTUS, but she must be made to squirm and begin to expose the phony leftist, racist, homophobe arguments. Conservative allow their a$$es to get beat by a child’s game, you must tear into ‘60s radicals, at first with dignity, later firmly like you would deal with a petulant child.

I think you are giving the pres a little too much credit. This isn't Darth Sidious here. He is trying to get someone on the court who is a mirror image of himself. The dems wanted to be the first to get a hispanic on the SC. That is why they fought against Bush's nominee so hard. Also – Hispanics are not some perfectly unified voting block like the Black vote is. She is a mediocrity along the lines of Harriet Myers. The only thing she has going for herself is her race. She has made racial statements for years. That alone should DQ her but her record is worse. She has been reversed by the higher court 60% of the time. That is a crappy record. She is not qualified. She believes in making law from the bench and she believes our constitution is not the law of the land and wants to bring in FOREIGN court decisions into OUR USA courts. If she does not like our constitution then why doesn't she move to another location. I suggest south America because there are plenty of places that would embrace her. We don't need her type on the Supreme Court.
I expect that Sotomayor will bring the wisdom of a female Hugo Chavez to the Supreme Court.
I really enjoyed the mini series version more than the original film. Jack Nicholson notwithstanding, the mini series adhered to the actual tale far better than the movie did. And the written story was always outstanding, so much better than either of the films.
Mod, there's a difference between commenting on someone that's _made_ a racist statement… and then referring to someone as a racist because of their skin color… if Sotomayor had NOT made those statements in her speech, she would not be getting hit with this label.

While I agree regarding the "Magic Negro" character in Green Mile and The Shining (I forgot about that one), I have to point out that Shawshank does NOT have a Magic Negro character. If you read the original novella "Rita Hayworth and the Shawshank Redemption", it reads damn close to the movie line for line. Morgan Freeman's Red was originally in the book an Irishman with flame red hair, thus the nickname. In the movie he became Otis Reding I believe and almost the exact same line was made as humerous.
In the movie Red is black because, well it's Morgan Freeman. And I for one will allow almost ANY character to be played by Morgan Freeman.
Hey moron, Sotomayor is the one who made it about race with her ridiculous remark. As an American of Mexican heritage, I find it insulting that this woman has no problem at all in using her race to guilt people into confirming her. Hollywood quite often morphs the "Magic Negro" into the "Magic Homosexual." You know, the well-rounded, level-headed, oh-so-loving character who just so happens to be gay. Are there any homosexuals in real life who are not so lovabable?
