When a Little ‘Profiling’ Might Be a Good Thing

You can also pop off to a cop and then expect the most powerful community organizer in the world to get your back at his next press conference. If you happen to be an African-American Harvard professor with a bad attitude, you can also scream racism and no one left of John McCain will doubt you’re wrong.
I also wonder what kind of lawyers they’re churning out at Harvard when their most well-know alumnus starts a statement with. “I don’t know all the facts.” and then doesn’t immediately follow that with, “So I have no comment.” Instead, he goes on for two or three paragraphs giving the facts as he was told them by his friend, the Harvard professor with a bad attitude, and then reaches a conclusion that the police acted “stupidly.”
What he meant when he said “stupidly” was that the arrest of the friend of the most powerful community organizer in the world was racially motivated. President Obama believes in one of the great myths of progressivism: The police are always wrong and always racist. Many of our progressive friends believe that any time a member of a minority is stopped they must be innocent victims of racial profiling.
What is racial profiling? It seems hard to make the case you’re an oppressed minority when after you mouth off to a cop and get arrested your high-powered mouthpiece gets on the blower to the governor who calls the mayor who calls the police chief — all resulting in the charges being dropped. Meanwhile, you’re on the phone to the only automobile executive with access to nuclear weapons asking him to give you a shout out at the news conference. I wish I had that kind of juice. I can’t beat a speeding ticket in my home town (where I know four of the five top guys in the police department and play golf with the county prosecutor).
I do know this, from the time I was a very young hillbilly living in rural Kentucky, my dad taught me that when you’re stopped by anyone with a badge and gun, you say, “Yes, sir.” and “No, sir.” Especially on a dark country road where there are no witnesses. You do what the cop asks and never lunge for the glove box.
Imagine the cops had acted the way President Obama and other liberals seem to think they should have, but in a slightly different situation. Let’s say you’re African-American and at home asleep with your wife and kids. Meanwhile, someone uses a crowbar to let some fresh air into your place, and this person is also African-American. A neighbor calls the cops and a white officer responds but the burglar (who’s in your house) informs the cop he lives there and that everything’s under control. The white cop says, “OK” and walks away. After you’re found dead will you wish the cops had done a little “profiling?”
After all is said and done, if I were a criminal in Cambridge I know whose house I’d break into tonight. Do you think the cops will even answer the call?

The funny part, is that cops, being the good guys, will do their job in spite of the insults. This case is about the abuse of law enforcement and a lack of education among peace officers.
We are supposed to be a Nation unified by the rule of law and just so you know – you can "mouth off" to a cop anytime you like.
The 4th amendment protects people in their homes and there's no such thing as "disorderly conduct" in your own home.
Disorderly contact is ALWAYS a bogus charge.

According to the police report, the disorderly conduct charge came after Mr. Gates followed the officer outside and continued to insult him and call out his mother.
The 4th amendment does not protect people in their homes, it forbids illegal searches and seizures. Through judicial review, the 4th amendment also extends to your personal privacy. The 4th amendment is not relevant to this incident.
Just so you know, you can not "mouth off" to a cop whenever you like anymore then you can mouth of to a judge whenever you like. If anything you say can in any way be perceived as a threat, you are breaking the law. Beyond that, Mr. Gates' words in this situation were grossly irresponsible and, in a more ignorant society, could threaten genuine progress and contribute to the cultural quagmire that is identity politics.
Well Granny I don't know what to say, I've had several crazy acting & sounding people work their way toward me puffing themselves up to do who knows what. The first one smacked me upside the head & a 15 minute fistfight ensued, so you have to be on guard with folks who are unpredictable. Of course I'm sure a Harvard professor would never smack anyone. There's mouthing off, then there's working up to do something crazy. I find it hard to tell the difference sometimes, so I have learned a lot of caution in dealing with people.
He was arrested in his front yard after continuing to yell loudly and draw a crowd. Note that your front yard is not your own home.
Disorderly conduct is an appropriate charge. Had the esteemed Professor not been beligerent he would not have been arrested.
Please pick the nearest local cop at a traffic stop and mouth off to him. Let me know how that works fout or you.

This was always a lose-lose scenario for The One and it seems the pressure is starting to get to him. He was obviously distressed the other day when the usually relIable Meredith Viera challenged him, and now this. Gates is a particularly unsympathetic character who is determined to get an apology from a cop doing his job.
One wonders just what pressure will be put on him to take the good professor off the hook- or what threats…
When do we have to respect authority. If this was not a cop and this was a Judge can you tell a Judge that he/she is a racist if you are in front of the bench on a matter? If this was a Judge would you be able to inquire about Yomamma? He was lucky that he was dealing with a cop and not a Judge.

He took DNA test to find out just how black he was. It turns out he is 57% white and 43% black. He said it was "Horrifying" to find this out. Mr. Jena, your hypothetical at the end of your article is exactly the way we need to deal with the Left – using LOGIC, which they sorely lack. This is how you break the trance of a certain amount of Independents and moderates and even average Americans who don't usually care about politics one way or the other.
You ask them a question that they cannot answer and watch them fumble. Rational and reasonable Americans – and I think there are more than we think there are – will start to wake up. There is an infraction called "contempt of court," and a judge can jail you for it. There is no crime called "contempt of cop."
I'm a liberal and I don't have any trouble answering that question. If Gates called in a break-in tonight, the cops would show up as they would for anyone else. Because the police exist to protect citizens, not to pick and choose the ones they like. If they can't live by those rules, they don't deserve the badge.

How about the kicker, Jeff? He *knew* Lynn Sweet's question was coming! Unfriggin' real! The arrogance of this man is too much. Let's see how well the apology to Sgt. Crowley goes at the beer-love-fest tomorrow night at the WH. Of course, he may not have any left having used them all during his recent tour of Europe.
I was in a customer's location one night about 2 years ago. I have the keys and my own alarm code. I was called in on an emergency service visit by the manager. The 2 workers who had just left, saw me in the store after they went for a midnight meal…they called the police who just happened to be right outside who had pulled over a taxi …I used the restroom for a sec and came out to see NYPD outside the door with a 9mm unholstered. Even proving to them who I was, my own key, alarm code and 3 forms of ID they still werent sure. Gates was a whining little POS. Nothing more.
How many times have ex-husbands or ex-wives gone back into homes where they used to live with revenge on their twisted minds? Sgt. Crowley had a whole bunch of things to consider when he went to that house and SAW A DAMAGED DOOR. Professor Gates had far more to do than present ID and yell about "yo Mama". In my jurisdiction Gates would have been hauled in on interfering with an Officer charges and they would have stuck.
And, yes, if there is a call to that house again, the bluesuits will show up, hopefully though, with an inexpensive digital recorder in a pocker.
I really do hope Sgt. Crowley stays firm on this, as he did nothing wrong. I'm not sure if you saw the link from the interview he did with the Boston TV station. He mentions not looking for an apology from Gates although, IMAO, it would go a long way if he did receive one.
I predict they'll be lots of photos of the two men shaking hands, over suds but if I were a betting man, I'd say Gates won't apologize. As for our prez? Who can say? I wonder if he'll be on or off script?

Professor Gates was an expert on racial relations. Doesn't anyone see how self-serving this whole event is? Actions that he precipitated resulted in himself and his chosen field being thrust to the front of society. Enrollment in his classes will probably go off the charts, and his eventual book will be a best-seller. If this hadn't happened, most people (myself included) would never know who this guy is, or care. He saw an opportunity to prove his own case (or at least make it look that way), and make some money along the way.
Mr. O's press flack says that tonight's meeting with Sgt. Crowley and Professor Gates is meant to be a "teaching moment." For whom?
As I see it, the only solution to this and future problems like it is to simply stop allowing white people to fill law enforcement positions. They cannot be trusted to make rational, prudent judgements due to their congenital predispostion toward racism and bigotry. That has been proven beyond all doubt. The only recourse that makes sense is fill all law enforcement ranks with blacks and various other minorities and oppressed underclasses. Then the world will be a better place. Then everything will be okay. Trust me.

As for profiling, well that's just good police work. Plain and simple. Walk a mile in a cop's shoes and you get what I'm talking about. If you can't do that, talk to one of them. I've found some are more than glad to shoot the stuff to those willing to listen.
See, kids, it's called education. It promotes genuine understanding, and will help us all pull ourselves up out of this quagmire of blissful ignorance.

Ya know what is confusing – the fact that if the woman who dialed 911 had seen the color of the guys she thought may be breaking into the home and then, when asked, told the operator what color they were, she would then be labeled a racist? That good samaritan should thank her lucky stars she did not see them. Can you imagine how that innocent act would have propelled her into the "Hall of Nasty Racists" for life?

If I was black, I think I would press to have statistics published that show racial profiling does not work as a law enforcement tool. Publish murder, rape, assault and robbery conviction rates as a percentage of the regional population. I'm certain the results would discredit profiling. Instead, the police can use statistical inference.
Is one race "better" or "smarter" than another? It should be obvious that there are cultural differences between races. Send a bunch of smart whites down to Haiti to poke voodoo dolls for a few generations, and similarly send a bunch of blacks to some highly educated environment like Cambridge, and in a few generations the highly achieving blacks will be profiling the whites. It's not only human nature, but proof that the primary problem with being black in America has nothing to do with skin color and everything to do with behavior. If I were black I would not be pointing accusatory fingers at whites, but at the too-large percentage of blacks who refuse to take responsibility for their own advancement, and who denigrate their race and degenerate their gene pool with despicable behaviors. It is a cultural issue, and the race component has been exploded way out of proportion. Blacks will continue to suffer second class-citizenship in this country as long as the values of industry, self-reliance and respect for education that made this country great are not embraced by the majority of the black community. Gates would probably accuse me of being a racist. That is the "stupid" part of his mentality. I have black friends and acquaintances that sometimes I don't even remember are black. I judge people on behavior, not skin color – - and probably most whites feel the same. The true racists are those who keep on harping on racism and hoping to find racist behavior to justify their obsessions.

I've interacted with a cop or two in my younger days, and I can guarantee you that if a cop tells you to "Stand over there and be quiet" and you keep yelling at him, by the third time he tells you to "Stand over there and be quiet" if you don't do what he says, he will slap some handcuffs you. Now, you may or may not get charged, but the bottom line is that he is there doing a lawful investigation and you are impeding his ability to do so. I've seen guys claim to know the police chief, I've seen guys standing on the sidewalk running their mouths about being citizens and having the right to say whatever they want, etc.
I've seen guys takien to a holding cell and then just let go no charges filed. But the bottom line is that no cop anywhere is going to let some sh*thead scream at him at him endlessly.
That's a real learning moment.

Well "darling" and/or "dear" (condescending much?), just my 2-cents as one of those abusive, uneducated peace officers….
I am a LEO in North Carolina so I have to refer to NC law. I realize that this incident occurred in Massachusetts, but I think I could give you a little perspective.
First, I guess it all depends on what you define as "mouth off" to a cop to be. In NC, you can say whatever you want to the police or ANYONE for that matter as long as you don't use abusive language, profanity or threats of physical violence. The first two are covered in the NC General Statute "Disorderly Conduct by Abusive Language" (there is also a "disorderly" charge dealing with alcohol but I don't believe that is a factor in the Gates case). The third scenario falls under "Communicating Threats".
As far as "disorderly conduct" in your own house, well, you got a problem there, Granny. From the reports, Gates was OUTSIDE his house when he was arrested. A common mistake that people make is that they can be standing in their yard and not get arrested for disorderly conduct. The simple explanation for this is that even though you are at your own residence, if you are OUTSIDE the physical structure of the house, you are essentially in the public's view and/or earshot. Even more simple, you can't cause a ruckus and distract your neighbors. So, the fact that Gates was raising cane to the point that people were stopping in front of the house because of a DISTURBANCE means that (according to NC law) he could be charged.
So, in short, if Skip had let it go, stayed inside and called his buddy Al Sharpton and complained about that cracker cop, he would have been handcuffless. But, oh well.
Again, I'm not sure what the laws (statutorily speaking) are in Kennedy-land, but they may be close. I don't know.
I did have one question as to why the charges were dropped on Gates so quickly. Was it a bad arrest? Maybe. I wasn't there along with Barry O. But, just for hoots and giggles, suppose it WAS a legit arrest. And JUST SUPPOSE that afterwords, Skippy called someone at Hah-vard, and someone at 1600 Pennsylvania Ave got wind and called someone ELSE at Hah-vard and then someone at the Cambridge PD got a phone call….and then, oh, I'll let you fill in the blanks.
From what I've seen and heard about Sgt Crowley, he doesn't seem to be a cop who charges frivolously. Again, I may be wrong.
The only thing I DO know is that Skippy is a friend of the "One". Said "One" has a rather lengthy history (not available at MSNBC) of "helping" his friends. (COUGH! STIMULUS PAYOFFS!! COUGH!! CUSHY DIPLOMATIC POSITIONS TO SUPPORTERS!! COUGH!! COUGH!! LOBBYISTS LYING AROUND THE WHITE HOUSE LIKE CORD WOOD!!!) Sorry…..had something caught in my throat.
Oh…and one more thing. If you want to refer to the Bill of Rights when trying to smear the brave men and women who put on a badge and protect EVERYONE (yeah…even YOU. Sigh.) at least refer to the correct amendment.
If…IF you had a point it would make more since when dealing with the 1st Amendment (I would tell you what it pertains to, but if you did not look it up for yourself, you would never learn). A 4th Amendment violation may have been valid if he snatched Skippy from his bathroom without a warrant or probable cause (another term: look it up). IT wold appear that Sgt Crowley may have had enough probable cause to arrest Gates when he was outside. And before you say, "BUT!" you can have enough PC (not political correctness) to arrest but it does not always mean the case will go to trial or even indictment.
One more comment before I go eat my dinner….
You even refer to LEOs as "peace officers" in your post. Keep that in mind. We "keep the peace". That peace was broken by a racist, elitist pal of the Community Organizer-in Chief. Of that, there is no question. Just try to put yourself in Sgt Crowley's position before you besmirch him and every other hard working, honest police officer in this country. Or would that be too "conservative"?

Jimmy, the point of the meeting is not for an apology to Sgt Crowley. Gates and Obama have already staked out their position that Crowley racially profiled Gates, and thus he is the guilty party.
The Won has NEVER apologized for his mistakes, and Sgt Crowley will be placed through the White House wringer by Rahm Emmanuel, Eric Holder and Obama, while Gates laughs.
The meeting to teach a lesson…to Crowley.
I've said basically the same thing about a real break-in at Professor Gates' house to my husband. If something else happens, and theoretically, I, am the policeman who responds….. I'd be awful slow getting into that house to make sure nothing happens to the sweet little Professor.

In short, I don't know too many officers who go to work wearing jack boots and who specialize in "disappearing" folks.

I am startled by the stupidity of people who do not understand the protocol that police follow when there is a possibility that someone illegally entered a home.
First of all, they might ask the person to step outside. This is to safely ask for ID and if there is anyone else in the house. A number of scenarios could be ongoing: Someone could be a hostage, or someone in the house may be threatening the victim. Or the person that was encountered may himself have a gun.
Just because someone tells the officer that he owns the house, he still has to provide proof that he rightfully lives there. If the person refuses to ID himself and put up an argument, then other action must be taken.

Bottom line is Officer C. was frustrated & angry ( not to mention underpaid & over worked), but never the less , had no legal means to make an arrest.

Yes sir and No sir….I was proflied along time ago because I was wearing a YANKEES jacket…. and I fit the description and I did nothing wrong and knew I would be let go…. about 10 minutes after the policeman asked for ID he let me go and explained it all to my parents… that is the LAST run in I had with the police and I am fine with that!!
So, if you believe in questioning authority, do you question Obama's authority to fire the CEO of GM? Do you question his authority to seize control of 1/6th of our economy thru his obamacare bill? Do you question his authority on anything?
