What’s ‘Latina’ Got to do With It?

The appointment of judge Sonia Sotomayor by President Obama to the Supreme Court is a classic example of how absurd affirmative action has become. And she unwittingly said it all in the following statement:
“I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.”
First of all, that is a foolish statement. Wise people don’t call themselves wise. And anyone who thinks their ethnicity (Latinos aren’t a race) or race makes them somehow more wise is not very smart. There are clueless people of every race. Life experience only imbues wisdom if you actually learn something from it. A lot of people don’t.
But in the Obama administration appointing someone based on their “story” and identity politics trumps qualifications. Martin Luther King must be rolling in his grave, because this goes against everything he preached.
Besides, when you have a black president appointing a Latina judge for politically correct reasons so that white politicians will be afraid to dissent, affirmative action has gone way past being dated.
It was a good idea when it started, as a temporary measure. But that was over 40 years ago. And times have changed. It’s not really needed anymore, but it’s widely abused. Those who use political correctness as a bludgeon for their agenda will try to keep it going forever.
Identity politics is racist, sexist, tribalist, classist nonsense. If our society is to ever truly grow up, we need to kill it off with extreme prejudice.
It should end. Bureaucrats never like to give up power to abuse the public for bogus ends. So it won’t go without a fight. But it must.
When you favor one race, religion or ethnic group over another it’s not only un-American, it’s bigotry. We can’t have an equal society until we get rid of political correctness and affirmative action.
People should be judged on their merits and not on their “story.” Stories are for fiction and con games.

When we have a Female Speaker of the house and a Black President, who is appointing a Latina female to the Supreme Court, and said Black President won the primary against a female, who is now the secretary of State. WHY? do we still have affirmative action laws?
Personally, I was hoping Obama would nominate the first openly gay, transgendered Swedish midget justice to the Supreme Court. I guess that even with all the progress we've made on civil rights, we still have a long way to go.
What's interesting regarding her quote is I don't see how that applies to the firefighters case. Wouldn't the fact that she isn't white make it impossible to see the case from their side?

This is an utterly unconscionable, though predictable, pick. Not only is Sotomayor the worst kind of judicial activist, she is also a blatant racist and her decisions – not just her words – betray that: She values racial-grievance outcomes over the law. This is one reason that her decisions are so often reversed on appeal.
The more I read about her, the worse she gets. She's been called, "a bully on the bench," "unintelligent," "blatantly biased," and many more such things by people who have worked with her, including some of her fellow liberals.
Should Sotomayor be confirmed, she'll be known as, "The Affirmative Action Justice," but with a dual meaning, if you catch my drift.
Lets see she is racist, has had 60% of her decisions overturned, several where the court unanimously ruled that her logic was flawed, has recently written a one paragraph decision (that should not stand) and overall lacks the intellect to be a Justice. Not to mention that apparently much like our pResident she has not read the Constitution, since she likes to make policy from the bench thus usurping the rights of the Legislative and Executive branches. Latina or not she should not be approved.

Not to nit-pick, but…Puerto Rico is a U.S. commonwealth possession, not a State in the Union. That is an important distinction. Besides, "Hispanics" did not form the United States; English settlers did (Yeah, I know…Scots-Irish settlers too). Her culture is quite foreign to ours. We should have let go of Puerto Rico by now.

The job of a Supreme Court Justice is to see that the law is applied correctly and consistently, make sure it is based in the Constitution and correlates to the intentions of the Founders, the latter applying only in certain situations where the exact wording of the Constitution can leave uncertainty. All but the very last bit can be done by a computer, such programs are already being deployed on lower levels for guidance and as a check against bias, someday computers may understand the intricacies of language sufficiently that all of it may be automated with human judges merely used for supervision. Thus the minority status of a Justice should have no weight whatsoever.

One of the White House spokescreeps yesterday said she was "more qualified than all the justices serving on the Supreme Court right now". Democrat spin doctors are so repulsive, I tell you.
It's not that affirmative action as an idea is wrong. It's that it should be income based, not race based. It started out ok as a assist to those held back, but years ago, it should have changed from racial preferences to income based. That way it would be acceptable to all, except the wealthy. And it would be fair to all.

Somewhere opportunity: better jobs, a business, better education, public positions of power and influence are taken from more qualified individuals and given by definition to a less qualified individual, by threat of real political force.

Since, in all probability, Sotomayor has spent her entire adult life in liberal confines (NYC, Yale, trial lawyers), I can see why she thinks white males are insipid. I have the same opinion of liberal white males.

AGAIN, Barack Obama only won by about seven million votes. Hardly a full mandate.
I think she's clearly not a great judge and I doubt that Obama really wants her on the bench. So why pick her? Because I think he expects her to be shot down, and here's why I think he believes that he will benefit him:
1. Obama knew that the Republicans would oppose his nominee, whoever it was. By picking Sotomayor, he baits them with her ethnicity and gender. If the Republicans jump on her in the wrong way, he can run to the Hispanic and female "communities" and accuse the Republicans of being racist/ethnicist and sexist.
2. If conversative Democrats join the Repubs in blocking her, he gives his own left flank ammunition to use against them in the next primary. Remember, they are the ones stopping his gun, tax, and environmental schemes.
3. By picking her, he placated both female and Hispanic pressure groups. IF she now gets knocked down, those groups will be motivated to turn out in the next election.
4. Moreover, if she gets defeated, Obama wins a virtual free hand in who he gets to appoint next. He can thus pick someone to his liking without having to worry about his own pressure groups. Or, he can make other pressure groups happy — how about selecting a black lesbian next?
All told, it's a win-win for him, unless the Republicans do this right.

It's an interesting read for an AP piece. While saying nothing great about the Republicans, the basic point to be taken from it is Americans are less interested in party affiliation as opposed to voting on the issues that concern them. Old style party politics, as represented by the famed Chicago Democratic political machine, is out of favor.
Please note how the article loudly mentions that the Democrats will lose if they stray from the center and press hard for a liberal agenda. Democrats read polls, and have been quiet about further reforms for what is politically a very long time now.
The better analysis, based on the contemporaneous news reports and polls, is voters choose to believe Candidate Obama simply was not as liberal as he was portrayed to be by conservatives. Now Number 44 has established a record as President, and 2012, even 2010, approaches.

The right move is not to run out right now and scream that they're going to filibuster her. (1) They can't win that filibuster, so it's an empty threat, (2) it will energize many to defend her, and (3) it will kick the RINOs into high gear — they love fighting their own party.
Instead, the Republicans need to methodically put her views and the consequences of her views to the public. Let the public get worked up. They will flood Capital Hill with angry calls and letters.
As the pressure rises, turn Obama's cynicism back on him. Go to the Hispanic/female communities and tell them how cynical Obama has acted in appointing someone that he thought would never survive the nomination process just to placate them.

Fox News conservative legal analyst Megan Kelly defended Sotomayor's arguments about "Wise Latina Woman" and also Ricci's "Disparate Impact" … and this is no accident. There is a reason Republicans are AFRAID to criticize Affirmative Action. White Women support it overwhelmingly.
Particularly now that most employment is government or government directed (GM/Chrysler/Banks, Green stuff, etc.) White Women can only "win" in employment, earnings, and power if White Men lose. Thus, Affirmative Action who's primary beneficiaries are White Women. [White Women dominate government employment, check your local Library or government office, the people you won't see is Straight White Men.] There are only so many employment slots and so much money and so much promotions. It's why Obama chose Sotomayor in the first place.
From what I've been reading, she's a divorced childless Catholic, so it seems unlikely. However, as still another Catholic on the Supreme Court she may be willing to overturn Roe v Wade.

You cannot appear to be negative on minority status, few Americans believe neutrality is possible. By the accounts I'm reading, she'll be a nightmare of a Justice who'll be readily discredited if she tries to stick out, and will be open to persuasion to go with the majority. Show you're being positive on minority status, that it's not an issue, let in this nominee that Number 44 is obviously expecting to be shot down, collect the good PR and save it for upcoming battles.
We are running out of language that is capable of describing these things. If Judge Sotomayor actually made this statement then this is hubris on a very large scale. How in love with oneself does a person have to be to announce to the world that they are "wise" and that their wisdom is based on a set of life experiences that are unique to themselves? If the judge were simply someone you might meet socially then it could be written off as simple pomposity. In a future Associate Justice such an attitude is deeply disturbing. The good judge may be setting herself up as that favorite of the media, the self-proclaimed "Conscience of the Court." It's a great gig that allows you to ignore constitutional principals while receiving the plaudits of the Washington illuminati. (Justice Brennan had it down to a science.) Ooops Sorrry…I shouldn't say anything like that. It might be taken as "mean spirited."

I hate to misquote Reagan but his quote that "I didn't leave the ___ party, it left me" is equally applicable to the GOP in the last two election cycles. Let Obama do his best, the next election will be a referendum on his policies and appointments – the first nominee appears to be just as we should expect. The man still hasn't stopped campaigning.
They've had elections where they could opt for independence or statehood and so far they've declined both options. This way they have all the benefits of US citizenship but they don't pay federal income taxes.
I am not nearly as concerned by her comments, in and of themselves (in their minds, I'd guess, most judges actually believe that, for one reason or another, they are better suited to be judges than many others.) I find it more disturbing that Judge Sotomayor would have the lack of restraint, temperament and simple common sense to actually give voice to her grandly delusional feelings at a public forum. Incredible.
I am sure she'll be confirmed — but I'd love to be a fly on the wall in the meeting room at the Supreme Court when Sotomayor, Roberts and Scalia get going.
My guess is that she'll turn out to be the Clarence Thomas of the left. She'll be a reliable liberal vote (as Thomas is a reliable conservative vote) — though, like Thomas, not much else. She'll vote on ideological grounds, never write any major opinions (as her opinions to this point show that she's really not much of a giant of legal thought), and will occasionally write a dissent that no one else will join.
…Sotomayor ruled against the firefighters in a perfunctory unpublished opinion. This provoked Judge Jose Cabranes, a fellow Clinton appointee, to object to the panel's opinion that contained "no reference whatsoever to the constitutional issues at the core of this case."

kadaka, it's not involved or subtle at all — it's basically the same thing as preparing an effective cross examination.
And you can't just give her a pass as you are suggesting. If her views are not highlighted now — in other words, if she's not "made damaged goods" — then she will disappear onto the court unless she does something monumentally insane.
The reason that guys like Scalia and Thomas draw such attention, whereas other Justices who vote with them routinely don't, has nothing to do with their views. It has everything to do with the perception of extremism that was created at the time of their nominations. The Republicans need to do the same thing to Sotomayor now the "nightmare" that you're talking about will go virtually unnoticed.
The most consistent concern was that Sotomayor,… was "not that smart and kind of a bully on the bench," as … clerk for another judge put it. "She has an inflated opinion of herself, and is domineering during oral arguments, but her questions aren't penetrating and don't get to the heart of the issue." (During one argument, an elderly judicial colleague is said to have leaned over and said, "Will you please stop talking and let them talk?")

Personally, I don't care where she's from. I don't hold being from New York against anybody. I do care about the politicizing of the SCOTUS, her judicial philosophy, her opinion of the Constitution, and whether or not she intends to legislate from the bench. Since the majority party has all the votes plus some that it needs to put her there, we can only hope for the best–whatever that is.

I take your statement "ensuring solid juristic competence" to mean that, IF you want to insure solid juristic competence" that is to mean that you don't additionally consider, or muddle your consideration, by also considering a person's entho whatever. Which is a long way to basically role out the "color blind" logic. I get it. I don't happen to agree.
As far as pandering, sure… I guess after 8 years of watching the dem's act like dumbos, its a great relief that they've learned some savvy from the right, whose basic existence is owed to pandering to a certain ethic group.
