TMZ said this "sex tape" was too racy to post. They've never shown such restraint before. Now we know the real reason. Carrie was a minor at the time. Sorry TMZ and fellow Prejean bashers. I'm not going to hate on someone because they fooled around as a teenager. Big deal.

I'm not a Christian. If a beautiful women takes off her clothes, I don't say "shame on you", I say "thank you".

Carrie Prejean, in the interviews I've seen, comes across as down-to-earth and quite likeable. I wish she had a twitter or facebook account that would list her appearances in advance.

Well, Thuyen, she made a media appearance on Fox News with Sean Hannity and admitted that there was a solo sex tape. See the clip at http://www.youtube.com/watch?v=_4A8g9cbBKc

Of course, I'm sure by coincidence, there are moments where she and Sean are plugging her book. She states that she's taking responsibility for her actions in the clip - too bad she didn't take responsibility when she was lying in her statements to the Miss California USA pageant about posing nude (and, conveniently, neither she nor Hannity discuss the fact that she clearly lied to them and, therefore, violated her contract).

PS: She claims that she was a teenager when the solo sex tape was made - which is why I believe many of the websites, such as TMZ, passed on buying it or showing it (showing, or even having in your possession, children pornography, is a crime). The photos of her in rhinestone-studded underwear were taken this year (post-breast implants) as she sent that photo to a sponsor of the pageant asking this sponsor if she was ready for the Miss USA pageant. The second set of photos, where she was exposing her breasts and nipples, were taken when she was over 18 (or else, there would be serious consequences if she was not of age - no such accusations have been forthcoming).

Hope this information further enlightens you on this controversy.

Yes. I have seen the photos. Here's a link to those photos with red stars covering nipples: http://www.femininebeauty.info/carrie-prejean (I have also seen them without the red stars). In these photos, she is wearing a fairly small vest with no bra or top. They were taken in connection with a Bliss magazine spread. Dominic Pertruzzi (as identified in the link) was the photographer. She has claimed that the wind blew her top open and the photographer took the photos without her knowledge.

I frankly don't buy that argument for several reasons: (1) She's looking directly into the camera; (2) The photographer has denied it (See http://latimesblogs.latimes.com/thedishrag/2009/0... (3) I'm sure she signed a release giving the photographer ownership of the photos (and if there was no such release or her agreement contained a "I will not pose nude or permit the release of nude photos of me" clause, I'm sure Carrie (and Charles Limandri) would have sue the photographer and the magazine - and there is no such lawsuit, as far as I know); and (4) If you really want to be sure that a photographer doesn't photograph your breasts and nipples, common sense dictates that you would not pose wearing nothing but a small vest.

You've seen the ones that show her bare breast, nipple included? And from what I've seen, Victoria's Secret models usually wear bras. It would be interesting to see examples of photos from that catalogue that outdo Ms. Prejean's.

WOW! Very informative post...thanks!

The other thing for people to remember is her contract did NOT end "the minute the pageant was over" (as claimed by the OP. She was to serve the rest of the year as Miss California, under the terms of the contract.

Have you read the contract so that you can definitively say what the obligations of each party, including those of the pageant, are? I doubt it - I myself have only read the portions made publicly available in connection with the lawsuits. It appeared to be, in my experience as an attorney who has read hundreds of (in my judgment) similar contracts, a fairly standard employer/employee contract which is favorable to the employer. I highly doubt the contract prohibited the pageant's officials from publicly speaking about their employee. In fact, under such an agreement, the employer's only real obligation is to pay the employee and cash and prizes that are promised.

Having followed this controversy from the beginning, I am not aware of pageant officials ever publicly (or even privately) threatening her for belonging to a church that was against gay marriage. They certainly did make public their stances for gay marriage - but I don't ever recall anything negative directed at her church (although they did voice their displeasure with her speaking at a televised event at her church without the pageant's consent -- as all televised appearances required the pageant's consent under the contract). Could you point out any such statements against the church for me?

Regarding her breast implants, I have 2 points (pun intended): (1) I watched the media interview with Shanna Moakler during which the interviewer asked her if the pageant paid for Carrie's breast implants and Moakler confirmed that the pageant did pay for them (i.e., the media already knew that Carrie had implants) -- I, as well as many people who watched the pageant (including my friends with whom I watched the pageant on television), could tell that her breasts were not real. It was even more plainly obvious when the nude photos of her (as well as bathing suit photos of her during the Miss California pageant) allowed a comparison. (2) The US Supreme Court decision, New York Times v. Sullivan, and the decisions emanating therefrom set the standard for issues of privacy -- basically, in a nutshell, public figures have a lower expectation of privacy than non-public figures and a person who says or does things in public can expect to have a lower level of privacy with respect to whatever they did or said in public. If you do not want people speculating or talking about your breast implants, you should not participate in a nationally televised contest in which you parade around in a bikini and are judged on your figure (including your breast size) - she lost all claims to privacy about the size (or realness) of her breasts by participating in the contest.

I read Carrie's lawsuit in full and nowhere did she allege that the pageant violated the contract. If she didn't think the pageant violated the contract, why would you? Perhaps you think Charles LiMandri is an incompetent attorney who failed to put in claims of contract violations in the lawsuit?

The contract was, essentially, a one-year employment contract. In exchange for the cash, prizes and an opportunity to compete at the Miss USA pageant, Carrie agreed to be bound by the terms of the contract for a year (not an unreasonable condition). After her contract was up, she could pursue her own course of action.

Sorry, but it is not in dispute. She signed a contract that asked if she had ever posed nude or semi nude - and she responded no. See this NY Daily News article: http://www.nydailynews.com/gossip/2009/05/06/2009...

Then she said, when the first set of photos came out, that they were the only ones. That turned out not to be true.
A set of photos where she exposed her breasts (nipples and all) were revealed. See http://photos.tmz.com/galleries/carrie_prejean_2 That is clearly semi-nude. Sorry, but a fact is a fact. She lied and violated her contract. But yes, it is true, the other party to the contract may, if it choses, elect to ignore contractual violations.

I was simply pointing out her lack of honesty.

"There is an assumption that the pageant released the tape to the media which seems unlikely."

The same pageant that released confidential info about her breast implants and probably outed her on the photos?

"I would guess that whoever gave the tape to them also tried to market the tape and handed it out. One really has to be a first class bimbo to go public on a sexual morality crusade with the photos she did and the sex tape floating around. That is first class stupid."

She did not go on sexual morality crusade. She simply took a stand on gay marriage, and got a voice publically because she was attacked viciously repeatedly by the pageant, so that of course would push her further away and take a stand even stronger.

First class bimbo?

She didn't ask for any of this kind of attention in the first place. The pageant made into a public traversty by continually attacking her day in, day out. Why should she keep silence in the face of all these attacks?
