EXCLUSIVE: Prejean Attorney — Pageant Countersuit Part of ‘Ongoing Smear Campaign’
by Big HollywoodFrom Carrie Prejean’s attorney Charles LiMandri:
This is just the latest installment in K2 Production’s ongoing smear campaign against Carrie Prejean. They have proven, once again, that they will use whatever scurrilous accusations they can dredge up – or invent – to try and tarnish Carrie’s reputation and her good name. It is both appalling and pathetic to see K2 and their friends in Hollywood try to destroy this young woman simply for standing up for her beliefs.

[...] UPDATE, OCTOBER 19, 2009: Big Hollywood: EXCLUSIVE: Prejean Attorney — Pageant Countersuit Part of ‘Ongoing Smear Campaign’ [...]
This is dangerous. It is dangerous for an employer to sue , smear or slander ex employees. she became an employee after she won and did a contract to make appearances.
Please post pictures of Carrie when you run a story about her. Thanks.
People should think twice before working for K2 Production.
Seems to me K2 Production just opened a whole new level of thuggery – Carrie will be winning this ……Big.

This is all because K2 Productions have received many verbal Arse Paddlings from their actions and their only means of defense is to continue with a smear campaign. American citizens know that K2 Productions should just cut thier tails off and head home. But they won't so bring it on!
Where is Carries contribution fund….I need to make another donation!
Gee, a link to FOX and not a "real" news organization?
The lawsuit also claims she failed to repay money K2 Productions advanced to her to pay for breast augmentation surgery…
Okay, when that first came out they admitted they had paid for them, no one said they had "advanced" the money. Oh look, they claim that was an "oral agreement."
"If that were not enough, K2 is informed and believes that there are additional photos of Ms. Prejean, yet to be published (and which K2 has not yet seen), that are even more graphic than the photos described that have been published in the news media," the suit stated.
"We have not seen them, we have no proof they even exist, but we know they are out there and they are dirtier as well!"
Plus K2 claims they can release private information about the plastic surgery, since it was so obvious that it had been done therefore it was public knowledge anyway? Gee, I doubt they could get away with that excuse even in Hollywood.
Hey, if they now say the money was advanced, doesn't that mean Prejean herself actually paid for the work? Would K2 claim the right to release info about "obvious" dental work that Prejean paid for?
The same mud they were slinging at the start, but now with some cow droppings mixed in for extra stink. Give it up guys, handling that stuff just makes you smell worse.
she should re-imburse them for her enhanced breasts … or return them.

I like Carrie, and I hope that BOTH of her implants get scholarships… as promised by Jerry Falwell Jr.
Can the Calif. pageant do a recall on he implants?
"…they claim that was an 'oral agreement'."
As anyone with two brain cells knows, an 'oral agreement' is NOT enforceable– leaving the only obvious reason K2 would make such a ridiculous claim: smear.
Boy, that sure is exclusive and exciting news: flaky beauty queen's lawyer has a statement about flaky organization's suit. Did the lawyer say he will do anything? No? He just complained and said stuff very much like everything he's said before? Scoop!
In news that you could actually bash Obama with if you wanted to, the Justice Department has yet to find a way to lay charges in a rape and kidnapping perpetrated on the government dime by government contractors. It'd go well with the obviously justified Polanski hating.

I hate to break this to you, but an oral agreement is just as binding as a written one. The key term being "agreement." Once both parties agree, you have a binding agreement.
You are so wrong about this, but thanks for sharing.
P.S. Some of us have actually taken classes on this subject, but one really doesn't need a class to know that an 'oral agreement' is no more than "he said – she said"

If any of you had bothered to read K2's countersuit you would know that Prejean is not the innocent saint/victim she portrays herself to be, because many of the worse things they contend about her are supported by her own words.
She may be an attractive woman on the outside but she is an ugly person to the bone. She is a conceited, vicious, self-serving liar. She lied about there not being any nude or semi-nude photos of her at all when she signed the contract to enter the pageant. She lied after the first photo came out when she said it was the only one and that it was taken when she was underage (K2 has proof in their complaint that she voluntarily submitted that same photo to a pageant consultant when she was 21 and stated in writing that it was "a recent photo of herself". When more photos came out – this time with her breast exposed – and she was exposed again as a liar – she claimed the "wind blew her top open" during the photo shoot. The fact that not a single hair is out of the place in the same photo seems to have escaped her attenttion – yet another lie on her part.
cont.
She was selected as Miss California and immediately started biting the hand that fed her. Read K2's counter suit and yoiu will know that she was a pain in their ass long before the whole gay marriage thing ever came about – that just became the stepping stone that she used to further her own ambitions.
K2 will win this lawsuit because they have a CONTRACT with Prejean, which she signed, and they have page after page of proof and evidence that she wantonly and blatantly violated the terms of that contract long before the Miss USA pageant and any of you hopped on her bandwagon.
By the way, Prejean's attorney, Limardi, was already working for and provided to her by the anti-gay marriage group she aligned herself with. He is the one who advising her to violate terms of the contract all along and then sending communications to K2 and Miss CA/USA organization daring them to do anythng about it.
All they have on their side is the "poor victimized Carrie" angle – no contracts or communications that support their positions they have taken or the choices she made.
She is going to get taken to the cleaners. I hope everyone buys her book because every dime of it is going to end up going to the charity that K2 gives it to after they spank her and her dumbass attorney in court.
Poor, poor liar hater, must have gotten out of the wrong side of their mamas bed.
Prejean is a strong woman, she will prevail.

No, you are wrong. Oral contracts can be as binding as written contracts. But, without a written agreement, it can be difficult to proved what was agreed to.
Agreements for sale or purchase of land, contracts for the sale of goods over $500, mariitial or prenuptual, or contracts that cannot be completed within a year are not enforceable oral contracts.
Maybe you ought to get you rmoney back from the classes you took.
I'd like to do a check on both to see how they are fairing.
First, the wind that blew her top open was requested by me. That is why it was so selective as to not mess up her hair.
Second, the loan for the fake boobies was verbal. Try to get that enforced in court.
It sounds like you got all your news from one source. You must get all of your news from the Times.
And you must be a tart or a lesbo…or both.
Sorry Humbucker…I just couldn't resist.
You're suggesting breast implants cost under $500? Thanks– that counts as today's big laugh.
Again, you're wrong– especially in the case discussed in this article. Perhaps you'll also suggest there were neutral witnesses to this particular "oral agreement" –involving a private medical procedure—to go along with those "$500 implants." No doubt K2 involved such witnesses to enforce their 'oral agreement' and Ms. Prejean went along with having private medical decisions discussed in the presence of these 'neutral' people. (rolling eyes)
There's no "again" to this. You are incorrect in your statement about oral contracts. PERIOD.
I don't give a damn about Ms. Prejean's boobs or the cost to augment them any more than I care about yours.
