EXCLUSIVE: Carrie Prejean Takes Legal Action Against Miss California USA Officials

LiMandri announced today that the former Miss California USA is filing a complaint in the Superior Court of California against Miss California USA officials Keith Lewis and Shanna Moakler, and publicist Roger Neal. The complaint cites damages to Miss Prejean including libel, public disclosure of private facts, religious discrimination, intentional infliction of emotional distress, and negligent infliction of emotional distress.
Miss Prejean was fired from her role as Miss California USA in June of this year, following several months of controversy over her answer at the Miss USA pageant regarding same-sex marriage. Lewis claimed Miss Prejean’s termination was due to a violation of contract. Miss Prejean’s complaint will refute that allegation, and demonstrate that both the chronology and factual evidence clearly show she lived up to all her contractual obligations, but was fired, harassed and publicly attacked solely due to her religious beliefs.
Charles S. LiMandri, attorney for Miss Prejean, released the following statement regarding the complaint:
“Over the past two months we have worked hard to provide overwhelming evidence that Carrie Prejean did not violate her contract with Miss California USA and did not deserve to have her title revoked by Keith Lewis. We will make the case that her title was taken from her solely because of her support of traditional marriage. Keith Lewis has refused to clear her good name or even to admit any wrongdoing. Therefore, Carrie Prejean is left with no alternative but to take her case to court where she expects to be fully vindicated.”

Their is an awakening in America that is going on from Carrie's situation to the over all concern about all American rights in general. The Bill of Rights is under fire and so is theConstitution in general. We are beginning to realize we have to take our country back. From Town Hall meetings and Tea Parties we see that change. This is a great country but sometimes we will have to rise up and protect the flag. The founding fathers knew this and gave us the format of government to make this possible. Everyone seems to think we have a right to free speech under all circumstances. WE DON'T. The constitution only protects us from the GOVERNMENT from interfering with our rights to speak.
A company, our boss, a TV station, etc can limit what's said by their employees on or on their property (or at their pageant) at any time. If they don't like what she says, they can fire her. She had the right to say it, but she's not immune from the consequences. If her employer (the pageant officials) don't like it, they can fire her.
Its amazing how many people actually believe we have the right to free speech under all circumstances. Only the government is prohibited from censoring.

This is all pretty stupid. Even if she didn't win because of her beliefs, the fact that she was able to say what she did say publicly kind of puts the whole 'free speech' thing to sleep. She exercised her free speech, and then so did the pageant, which was entirely within their rights. Free speech really only applies to the government and those entities that receive any sort of funding from them, as in, the government is prevented from abridging those rights, but all bets are off for the private sector. The pageant is not government supported or financed, so the argument should be moot. Prejean's free speech was never violated, but in principle it was actually supported; no one told her what to say, but let her say what she wanted. The pageant judges just happened to disagree with her.
It's unfortunate that something so inconsequential can inspire so much uninformed debate. Why not go to a different page where they are discussing something that actually makes a difference and make a smart comment there? Whatsamatter, not enough celebri-teats for you?

The "good Lord" has defined what is a valid relationship and what is not. Read the books of Exodus, Leviticus, and Deuteronomy in the Old Testament and Paul's, Peter's and Jude's letters in the New Testament and you will see that God condemns all homosexual acts and unmarried sexual activity (fornication) of any kind. All of the prophets and Jesus Himself always and only validate marriage between a man (by birth) and a woman (by birth). God's word is very simple. Donald Trump, who owns the organization, looked over the pictures and decided they did not constitute a violation of the contract. The photos were revealing, but not explicit, and didn't show anything. Not that I agree with her having taken the pictures in the first place, but everybody has different standards of behavior. But the point is, they didn't violate her contract, according to its owner.

Actually, most of the hate was coming from heterosexuals who were trying to show how "tolerant" they were. As Prejean has said repeatedly, she received a lot of supportive emails and calls from people who were gay who despised the way she was treated. The best way to confront the bigotry she faced is not to display it on web sites while claiming to defend her.
Actually, she didn't pose nude. There were pics taken of her discreetly covering herself during a photoshoot, but the more revealing ones were actually taken without her knowledge and released by the photographer after the controversy became heated. If you'd like to see one of their pageant winner's nude, check out the winner last year, who did a topless spread in Maxim before her current title was up (and the fact that the pageant promoted her pictorial). You see, it's only bad when someone you don't like does it.
I like the idea of buring the rainbow flag. That ideology has already cost more lives than all wars in recent memory, and all terrorist acts. Now they are terrorizing those who have any religious beliefs left. If it were up to them, we'd all be gay, and we'd all be dying miserable deaths while costing normal people billions of dollars a year.

I am in favor of free speech and thought it was rather brave of her to uphold her beliefs on a national stage.
But the clear fact is, she failed to uphold her contracts as Miss California! She did her own thing even though she is clearly bound by the Miss USA pageant rules. And for someone with such devout religious beliefs, she didn't even disclose that she had posed nude and partially nude professionally (something she failed to disclose to Miss USA even though it is a clear violation of their rules).
This isn't an issue of religious discrimination. People, don't side with someone just because you think she is a saint, bigoted, etc etc., she just failed to fulfill her contract. That's also why Donald Trump made the ultimate decision to "fire her" AFTER a fair warning. She's just an attention whore crusading under self righteousness.

That's why they sent dozens of bogus requests (including a Playboy photo shoot) to her. Once she turned down enough numbers, they could claim she wasn't performing her job duties. Perhaps you should have read my comments a bit more closely . . . I did not make any statements that said God has (or has not) defined a valid relationship. I have read the Bible (and thank you for your invitation to do so) and I am familiar with what it states.

The First Amendment only protects individuals from government restriction on speech. There may be other laws that protect individuals in other circumstances, but that is not free speech.
It is also unclear from a legal standpoint whether she is actually an employee of Miss California. This might bar her from being protected under anti-discrimination laws. Also, anti-discriminaton laws are not part of the constitution, they were passed in the 60s by liberals.

I think her lawyers have thought long and hard about this, and if they thought it had no merit, I do not think they would proceed with the case. This is shaping up to be a lawsuit that the public will follow, and I doubt a respactable law firm would risk making idiots out of themselves.

No, it's not okay, but the issue of whether Carrie is an employee or an independant contractor (to whom anti-discrimination laws typically don't apply) is a technical legal issue. Doesn't mean what they did is right or wrong, it just might not technically be discrimination, from a legal standpoint.

They publicly said they were looking for a reason to fire her, then released private emails, then finally fired her for supposedly breaching her contract (but without a single example of her doing so). Has her contract been posted anywhere on the internet? I'd like to take a look at it so I can make an education decision about whether or not she breached it. If she did not, then she certainly does have a cause of action. However, her contract may have a clause stating that she is an independant contractor (as many contracts do), in which case she may not be eligible under California's anti-discrimination laws.

Her contract and the reasons the pageant has cited for firing her have been published a number of times (at least a half-dozen here on Big Hollywood). Lewis claims she was turning down too many public events, but the events he sent her included a Playboy photo shoot (which would have been a breach of her contract to accept). It's possible that a court could find her case doesn't have merit, but I've heard from both sides and it doesn't appear that the pageant has a leg to stand on. It doesn't help their case that the people running it publicly attacked her for her beliefs, and one of them quit because of Trump's refusal to fire her, only to rejoin immediately after she was fired.
Their public posture has been that they don't like Prejean because of what she believes, and have made numerous statements to that effect. Good luck trying to explain that in a court of law.

They are claiming that Prejean was fired only for not doing "enough" events (even though there is no specific number required in her contract). All Prejean's legal team has to do is show one contestant at any time (present or past) who did the same number of events, but wasn't fired, and she wins her case (although since it's a court of law, a judge could require more or even less proof).
Let's be honest. She was fired because the people that run the California organization hated what she said about gay marriage. That would be tough to prove, but we all know it's true. You can read any article quoting Moaklar or Lewis and see them say it (sometimes in those exact words). They tried to get her fired for several different reasons, until they found one that stuck. It's going to be really difficult for them to defend their public statements and contradictory claims.

I don't totally disagree, but I've noticed that gay men often steer women into appearing less effeminate. You can't help but be influenced by who you're attracted to, so their opinions with regards to women's beauty is affected and not necessarily the same as a straight man. First, "separation of church and state" simply means that both entities have different functions. Hence, a pastor being Commander-in-Chief is as ludicrous as the government editing sermons in a church. Let's not get confused here. There were no violations of free speech. The constitution sets limits on the power of the federal government. It does not give any rights to people. Here is what the 1st amendment says:

Every child has the right to know who there biological mother and father are and to expect to be raised by them. While this is not always possible it is best ensured by marraige.

Funny….I was unaware that marriage was a "right." Could you please find the passage in the Constitution where it spells that out and let us know? Last time I checked, it was a privilege that required people to have State-sanctioned licenses (like driving), and people could be denied for a number of reasons. How do you explain people who never meet the right person? Are their "rights" being denied?
I wouldn't mind debating the point if people on the Left weren't so unbelievably uninformed on the issues. As someone who isn't against gay marriage, I should be easy to convince to be in favor of it, but people like you make me want to stay on the fence. Really? Could you provide the quote? Because I read Ms. Farrell's initial speech, where she said she disagreed with Prejean's opinions, but wouldn't talk about politically charged issues. Interesting. It is not the government that is behind the boycott. Also, Mr. Jones to my knowledge is a private citizen not an elected official. if a Christian group that I belong to want's to boycott the New York Times or any company that advertises there that is a right granted by the constitution. In that sense, yes, the government gives us the right to express ourselves via a boycott.

She had her free speech; no one silenced her; there's a conflating of two issues: did she have her free speech? YES. Did the company who hired her have issue with her contract related to her schedule? YES. Even if they did have an issue with her statement & fired her – too bad. If a Christian organization hired a woman who agreed that she would adhere to their standards & values, then went and got an abortion, they'd have every right to fire her. Oh, that's right – that did happen, in New York City and it was their prerogative to get rid of her. Either you uphold freedom & free speech or you are about control – which side are you on?

She was fired because she failed to live up to her contractual obligations. Give me a break please Trump even gave her a second chance after missing a lot of the obligations and she failed a second time. I have no problem with freedom of speech. She has every right to show that she doesn't know how to articulate an answer a question. She does not however have the right to expect people to keep her at a job when she dicides to abrogate the responsibilities of that job. She was a participant on a beuaty pageant that was seen on national TV. She gave interviews and disclosed private facts herself. What about the freedom of speech for the people that do support gay marriage and don't like it when holier than though bigots try to force their opinions down others throats. To be honest even if I were religious and ultra conservative and believed in her views I would not like to have her as my spokesman. I prefer people that can actually articulate their opinions without sounding like airheads.

Thank you so much for clarifying what you meant. I wasn't certain if the Bible quote was being directed to Zedek alone. Unfortunately, I have seen other people use that same Bible quote more as a bludgeoning weapon. We do need to realize none of us are perfect and that none of us will have a perfect view nor perfect expression of our views.

We can have passion regarding our individual opinions without resorting to personal attacks of those with differing viewpoints. Name-calling other commentators merely because they have a differing view adds nothing to a discussion. Of course, a person spewing out unfounded accusations may be merely trolling to stir up responses.
That said, I do not mean that we cannot criticize someone for the known actions that they have taken. Actions may be misinterpreted, but can be part of the supporting evidence for taking a particular viewpoint. What public actions Carrie Prejean, Perez Hlton, Keith Lewis and others have taken is important to the discussion. And to the pending lawsuit.
It's so good to read people of differing views agreeing on free speech.
