EXCLUSIVE: Carrie Prejean Takes Legal Action Against Miss California USA Officials

LiMandri announced today that the former Miss California USA is filing a complaint in the Superior Court of California against Miss California USA officials Keith Lewis and Shanna Moakler, and publicist Roger Neal. The complaint cites damages to Miss Prejean including libel, public disclosure of private facts, religious discrimination, intentional infliction of emotional distress, and negligent infliction of emotional distress.
Miss Prejean was fired from her role as Miss California USA in June of this year, following several months of controversy over her answer at the Miss USA pageant regarding same-sex marriage. Lewis claimed Miss Prejean’s termination was due to a violation of contract. Miss Prejean’s complaint will refute that allegation, and demonstrate that both the chronology and factual evidence clearly show she lived up to all her contractual obligations, but was fired, harassed and publicly attacked solely due to her religious beliefs.
Charles S. LiMandri, attorney for Miss Prejean, released the following statement regarding the complaint:
“Over the past two months we have worked hard to provide overwhelming evidence that Carrie Prejean did not violate her contract with Miss California USA and did not deserve to have her title revoked by Keith Lewis. We will make the case that her title was taken from her solely because of her support of traditional marriage. Keith Lewis has refused to clear her good name or even to admit any wrongdoing. Therefore, Carrie Prejean is left with no alternative but to take her case to court where she expects to be fully vindicated.”

Their is an awakening in America that is going on from Carrie's situation to the over all concern about all American rights in general. The Bill of Rights is under fire and so is theConstitution in general. We are beginning to realize we have to take our country back. From Town Hall meetings and Tea Parties we see that change. This is a great country but sometimes we will have to rise up and protect the flag. The founding fathers knew this and gave us the format of government to make this possible. Carrie is a patriot and deserves our support .

She did not appear on talk shows expressing her beliefs until AFTER Perez Hilton had his temper fit when he didn't like her answer (which ultimately led to her firing). Miss Prejean did not libel the organizers, she did not claim they were narrow-minded, bigoted or opportunistic. She says they breached their contract with her and libelled her. Now she is asking (reread that – asking) a court to adjudicate. The only issue of free speech is contained in her allegation that she was fired for what she said. Did you notice the gracious reaction of Mr. Perez Hilton — a veritable paragon of moderation, he!

Everyone seems to think we have a right to free speech under all circumstances. WE DON'T. The constitution only protects us from the GOVERNMENT from interfering with our rights to speak.
A company, our boss, a TV station, etc can limit what's said by their employees on or on their property (or at their pageant) at any time. If they don't like what she says, they can fire her. She had the right to say it, but she's not immune from the consequences. If her employer (the pageant officials) don't like it, they can fire her.
Its amazing how many people actually believe we have the right to free speech under all circumstances. Only the government is prohibited from censoring.

The Prop vote in California, which voted gay marriage down, was the proper way of handling the issue, let the people decide. I suspect that if you held such votes in other gay marriage states, you would get the same result. We need to go back to majority rule.

A lawsuit settles nothing here, and she makes a mockery of her faith by turning this into an opportunity to take money from anyone, even if they were wrong to do what they did. This is all pretty stupid. Even if she didn't win because of her beliefs, the fact that she was able to say what she did say publicly kind of puts the whole 'free speech' thing to sleep. She exercised her free speech, and then so did the pageant, which was entirely within their rights. Free speech really only applies to the government and those entities that receive any sort of funding from them, as in, the government is prevented from abridging those rights, but all bets are off for the private sector. The pageant is not government supported or financed, so the argument should be moot. Prejean's free speech was never violated, but in principle it was actually supported; no one told her what to say, but let her say what she wanted. The pageant judges just happened to disagree with her.
It's unfortunate that something so inconsequential can inspire so much uninformed debate. Why not go to a different page where they are discussing something that actually makes a difference and make a smart comment there? Whatsamatter, not enough celebri-teats for you?

I'm an otherwise conservative person who has no problem with gay marriage but I DO have a problem with how Ms. Prejean was treated. Prejean was attacked publicly for things she never said or implied, then the people she worked for publicly said they were trying to fire her, then they released private information about her, then they did fire her (and then released more private information). That's what discrimination looks like. Evidently you've never seen it up close (or you were the one doing it, so didn't notice what it did to the other person).

The "good Lord" has defined what is a valid relationship and what is not. Read the books of Exodus, Leviticus, and Deuteronomy in the Old Testament and Paul's, Peter's and Jude's letters in the New Testament and you will see that God condemns all homosexual acts and unmarried sexual activity (fornication) of any kind. All of the prophets and Jesus Himself always and only validate marriage between a man (by birth) and a woman (by birth). God's word is very simple. Donald Trump, who owns the organization, looked over the pictures and decided they did not constitute a violation of the contract. The photos were revealing, but not explicit, and didn't show anything. Not that I agree with her having taken the pictures in the first place, but everybody has different standards of behavior. But the point is, they didn't violate her contract, according to its owner.
