An Open Letter to Speaker Pelosi

I’ll make this brief because I know you are busy.
I wanted to remind you of the oath you first took in 1987 and reaffirm at the start of each new Congress. It reads:
I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.
Maybe I am missing something but I read nothing about political parties, putting your interests above the nation’s, or putting your party’s interests above the nation.
You now admit to attending the briefing where waterboarding was discussed but was told the CIA was only considering the use of the technique. Even assuming that to be true, you never objected to the “future use.” You said nothing, not a single word. Your most recent explanation for failing to speak up is, “No letter or anything else was going to stop them from doing what they were going to do. My job was to change the majority in Congress and to fight to have a new president.”
No, that is not your job. The oath you took clearly defines your job.
If you believed laws were being broken it was your duty as a sworn representative and a citizen to speak up. The Federal Criminal Code at 18 Section 4 applies to everyone and defines “Misprision of Felony” as “whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.”
If you thought a crime was being committed it was your duty to report it. If, as I suspect, you had no issues with the Enhanced Interrogation Techniques as discussed in the briefings then I applaud you for putting the nation’s safety as a priority. That was your duty and you honored it.
Our servicemen and women have taken the same oath to “protect and defend.” As Memorial Day approaches let us remember the many who have given their lives for this nation regardless of the political party in power. The Marine Corps has three core values: honor, courage, and commitment. A Marine is expected to live all three. Congress should adopt the same core values. At this point I wish you would pick just one.

Pelosi deigns to answer your eloquent and pointed correspondence (especially as you aren't a constituent in her district), hell will freeze over, the President will admit to a mistake and pigs will fly. So, I won't be holding my breath. But I won't let her dour, botoxed face cast a shadow on the happy and thoughtful Memorial Day I will be celebrating this year with my family. Hi, Bev: Cindy Sheehan actually ran in the last general election as a "reform" Democrat because Pelosi was too conservative. Even San Franciscans didn't buy that one. But, unlike Pelosi, Sheehan never diverged from her stated agenda. You have a pretty darned good understanding of San Francisco for a gal from way back east.
the constitution she wants to protect is of the Algore 'living breathing document' type. Meaning they and activist judges can interpret it as they like. Supersede the voters, and congress if necessary. Complete power, and everyone else is chattel.

Bravo Mr. Hamer. So much stupidy over a virtual interrogation technique. It's sometimes frightening to realize she's one of us. She hails from this planet (I think). She was raised here in a devout family, she's a college graduate, she married well, she's super wealthy, she's been involved in politics much of her life, and she was elected to the HofR over 10 years ago. How sad is it that somewhere in there she failed to learn honesty? She really should emulate BHO's approach to politics and apologize.

At the time of the founding of this nation the idea of outlawing political parties was discussed. It was feared that the Party System would constitute a shadow Govt. that was not representative of the peoples wishes. The idea of outlawing parties was rejected because how would like minded individuals organize for a political purpose. Both Parties right now are interested in one thing and that is being the dominant party and the power that comes with it. The Professional Political Class is the real problem and the current Parties are the symptom. We the voters are responsible because we keep re-electing these bums. I say for the forseeable future whether you are a liberal or a conservative if you love this country never ever re-elect anyone. After 3 or 4 election cycles the problem will self correct.

We have a similar problem here in Illinois with Richard "DICK" Durbin. The guy keeps getting re-elected yet I have never met anyone who actually voted for the guy. Maybe they're embarassed?

It does not matter if a felony was comitted or not, if someone believes a felony is being comitted and it is not reported that is a crime. Failure to keep your oath of office as a member of congress in wartime can be considered treason if it gives aid and comfort to our enemies. Normally a wide lattitude is given Congressmen and Senators because of the political component because it is also assumed only People of good charector would be qualified to run or be elected. Oaths don't seem to matter much anymore, Clinton lied under oath and while he was impeached he is still popular. In times past an oath breaker was automatically an outcast from civilized scociety.

Mr. Hamer – you make an appeal to Pelosi to recall her oath (not likely) and then honor the oath (laughable – not your appeal but the chances it will happen) The number of people in our country, I'd say the world is diminishing each passing day. Just look at the divorce rate. So many spouses (not all) ignore their vows so quickly and completely you wonder if they even heard the words when they were leaving their lips. In "My Blue Heaven", the Steve Martin character says "Everybody thinks they have a sense of humor, even people don't have one." Now replace the word humor with "honor" and you have a picture of the world today. Thank God for law enforcement, fire fighters and the military where people who really do know and practice life with honor still reign.

She regularly gets around 80 percent of the vote in SF. When I lived there I was among the 8 percent Republican/Conservative vote. I agree that no one likes her but the D next to her name on the ballot guarantees her election. She'll never resign her seat because there will be no local pressure for her to do so. She should resign as Speaker though.

And don't forget we have the largest Chinese community outside of China. Chinese food in all its many variations are ubiquitous throughout the city.

California is notorious for the same thing. Governor Edmund G. (Pat Brown) kept getting elected, including beating Richard Nixon after he left the vice-presidency. They've had over forty years now, and still nobody has ever been able to find anyone who actually admitted to voting for Brown. At least a few people will admit to voting for his son, former Governor Jerry Moonbeam Brown, who is now our illustrious Attorney General.

And waterboarding is both torture and illegal according to treaties the U.S. has signed, although it seems that with some conservatives, the law is only to be obeyed when convenient, and the Constitution is toilet paper when its provisions don't let them do what they want.
And let's be honest–the is whole tempest in a teapot is designed to draw our attention away from the real criminals, the torturers and torture-enablers in the Bush Administration.

Where is the anti-torture clause in the Constitution? I don't seem to remember that one… PS: the US constitution trumps ANY treaty in regards to our national sovereignty if the two come into conflict. (I had this argument with someone over the Sea Treaty from Hell (aka, the UN)).

Note that those powers are invested in Congress, not in the Executive Branch. The Executive Branch also cannot unilaterally break treaties without the consent of Congress. So there was no conflict with international treaties, except in the minds of Lord Bush and Darth Cheney, and their minions, the Torture 13.

Congress has not yet defined or approved the claim of an "offense against the Law of Nations." (which is the part that I'm assuming you're using). They keep talking about it, (and certain leftie Senators in particular) keep trying to get it started, but it never gets any momentum. )

So because they used a unique term.. that means what? So the current administration is using a term that was in the memo originally? I'm not sure what the argument is there?
So far, the only name that I know of besides Pelosi who was listed as being at various briefings and wasn' t was Rockefeller, and the report even states "was briefed later"… Pelosi claims not 'briefed at all'?
As much as I think he's a weasel for the most part, the one guy I would trust in his comments in all this is Leon Panetta, and he's one that says "she was informed".

That's rather the point of the EIT memos- there is no clearly-defined working definition of torture, which is why the CIA requaested legal guidance.
I'm guessing you're making the claim that Congress has to write up an order to 'authorize torture/interrogation techniques'' because of the Law of Nations (#5) before we can interrogate captured terrorism suspects, EVER?
Again, this goes back to the Pelosi comment.. she was briefed about interrogations (again, depending on which story of hers use accept as being the truth, if any of htem.)… she didn't raise an argument then, so there she must have seen NOTHING wrong with it back then…

But the difference is that we want Pelosi to step down for lying about not being briefed on waterboarding, and then lying again that the CIA lied about it. I don't want her federally prosecuted for okay-ing waterboarding. I still think waterboarding is an acceptable way to gain information from an enemy combatant (and irony is that so did she, until it was politically expediant to say otherwise).
The only argument here is, is Pelosi being asked to step down for lying to Congress and the public, or is she being asked to step down for allowing/knowing about the torture interrogations?

The off the cuff response any modern liberal will tell you is that republicans and conservatives is what is endangering America, so anything Pelosi does to hurt them, is protecting the country.
That's the real sickness of modern liberals. They believe the greatest threat to the world is their fellow Americans. That's some serious sick stuff.

I think the former VP along with the former President would be happy to have charges brought against them by this administration and congress over enhanced interrogation. After all; in an order that Barack signed as President left open the possibilities he may use these technics or others if we are attacked again.
The left will lose big time in court and the issues would be argued by experts rather than the media and political hacks that distort the truth. Let lawyers do the distortion they by law have to follow some basic rules of law in the presentation of evidence.

If she continues lying, her SF jury will due an OJ Simpson verdict, if she admits the truth, that she did the right thing at the time, it is a guilty plea to her jury and she is dead. Bob, great post, 1st, if she thought anything was a crime and did nothing, she did a felony. Neither she or Holder thinks any of it was a crime, only that their enemies (us) are guilty of anti-party thingees, which are capitol offenses to them. 2nd, you, I think, know that the stuff used only works sometimes and is not reliable without verification. As Star Wars Jabba the Hutt told our lad Luke when Luke tried the mind control stuff, "young jedi, your jedi mind control tricks will not work with me, only with the weak minded fools". Some of the bad guys in custody are weak minded fools; we did the right thing, and she knows that.
A lot of what you talk about was covered in the Anti-Federalist papers and by others such as Patrick Henry and Thomas Jefferson. Unfortunately, the apathy of most of the American population will in all likelihood, allow this gross abuse of power to continue at the expense of we the people no matter what those of us who actually accept responsibility for our actions think, say or do.
Your forgetting the ulterior motives I believe –
Free trips from lobbyists and other action committees and special interest groups
Large cash bonuses to friends who then pass on some of that "stimulus" to the pols as campaign contributions or through family member's businesses (See Harry Reid, San Fran Nan's husband as just a couple of examples)
Power seats in the UN when they can enforce international law here despite our constitution … and once you start down that road, it gets into crazy stuff that sounds almost like conspiracy theories at the moment … but is becoming a more and more realistic outlook at a frighteningly fast pace.
How is it that these tactics are considered torture by your administration here and not when they are used in respects to someone like John Demjanjuk or those members of the Armed Forces who protect your freedom to remain so blissfully unaware of just how dangerous this world remains?
(The point is not whether John Demjanjuk is or is not guilty here, so please do not bore me with those arguments. He has already been acquitted once, but I suppose double jeopardy has no real meaning when it does not suit the political motives behind it. It is rather like what your outrage would be if we followed the Geneva Convention with the individuals who are now guests at Guantanamo … where they would have been shot as spies and subversives … but the Geneva Convention too is only important as long as it supports political ends I suppose)
